Third-Party Assets on Your Land

11 April 2026

When trees, vines, buildings, or other structures situated on a parcel of land belong to someone other than the landowner — or when a well, a small plot containing a well, or any other small area of land including channels or reservoirs for the conveyance or storage of water falls within the boundaries of a property but belongs to a third party — and the Director considers a readjustment impractical, the landowner may apply to acquire them compulsorily.

Compulsory Acquisition of Third-Party Property (Cap. 224, Articles 33 and 33A)

Based on communication with the Larnaca District Department of Lands and Survey, where removal of the note is required, this is done by way of a handwritten application. The district Land Registry then requests confirmation of "drying out" (αποξήρανση) from the relevant community council and proceeds to cancel the note automatically.

According to the Land Registry, the note does not prevent any transfer of the property, provided the new owners accept it along with the rest of the property's history at the point of transfer.
